Complying Development Certificate

Complying development is a streamlined process of development approval, which avoids the complication of applying for approval through the local Council. It combines planning and construction approval, and makes gaining approval quicker and easier. The State Environmental Planning Policy (Exempt and Complying Development) 2008 (SEPP) outlines the prerequisites for complying development, meaning that it is a code-based assessment.

Complying development is available for a variety of development types, including:

  • New houses – single and two-storey
  • Alterations and additions
  • Swimming pools
  • Granny flats and studios
  • Ancillary developments – carports, sheds, garages, pergolas, decks

Construction Certificates

If your development does not qualify as complying development, you will need to make a development application to your local Council. Before any building works can commence, a Construction Certificate is required, which verifies that the relevant provisions of the Environmental Planning and Assessment Regulation 1994 (EPA Regulation) have been satisfied.

Principal Certifying Authority

The Environmental Planning and Assessment Act 1979 (EPA Act) requires a principal certifying authority (PCA) be appointed before any work is commenced on a development. The PCA’s role is to assess the building’s suitability for occupation in accordance with relevant building standards before issuing an Occupation Certificate.

Mandatory Critical Stage Inspections and Occupation Certificates

Under cl 162A of the EPA Regulation, there are a number of mandatory critical stage inspections that must be carried out by the PCA. These are designed to ensure that the development is built consistent with what has been approved, and that it will meet the accepted standards of health and safety. There are critical inspections required for all types of development, which may include:

  • After the excavation for, and prior to the placement of, any footings
  • Prior to pouring any in-situ reinforced concrete building element
  • Prior to covering of the framework for any floor, wall, roof, or other building element
  • Prior to covering waterproofing in any wet areas
  • As soon as practicable after the barrier has been erected
  • After the building work has been completed and prior to any occupation certificate being issued

Once the development has satisfied all the relevant critical stage inspections, the PCA is able to issue an Occupation Certificate. Pool Fence Inspections

There have been significant legislative changes when it comes to swimming pools in NSW. Pools now must be registered on the Swimming Pools Register. From April 2014, pool fence compliance certificates are required before properties are sold or leased. Further, an inspection must be carried out to ensure that the pool’s child-resistant barrier is compliant with the Swimming Pools Act 1992.
